That icon probably went through at least two revisions and was probably selected from several concepts. It's not just one little image it's the hard work of the people who worked hard on that art that has been stolen.

I've been involved in copyright lititgation over artwork before. I used to sell flash to local tattoo shops until this moron started stealing my work and calling it his own and selling it to shops the next town over. I just happened to walk into one of them with a buddy of mine and there was my work on the wall. I got the information on him from the owner, explained that the work was mine. I didn't get any real money from him because he was pretty much broke but I did gett he satisfaction of seeing a cease and desist order placed on him.

Actually, it's exactly the same image, just the colors have been shifted slightly. IANAL, but I think they could sue if they wanted, just like mcdonalds could sue you if you decided to use their logo, but it was red and blue instead of red and yellow.

Outwar has just taken ANets picture, tweaked a couple colors and resized it a bit.

Unfortunatly ANet supply these images for free and without any constraints on which website they are placed on i.e the only cryteria is that it is a fan site. The people of this site if taken to court can easily just say that it is a GW fansite and that they where in the process of adding some GW infomatin and forums etc.

Yes, they're making absolutely no money from selling advertisements. They're not some form of a company. /sarcasm

Just because they don't charge anything directly to their users doesn't make them non-profit. They're blatantly not adding information or having anything to do with Guild Wars at all. Arenanet did not release them "without any constraints;" their specific Terms of Use is here.

I'd also like to point out that it is not necessary for the offender to make a profit from the theft of copyrighted material. Any infringement of copyright can be fought with both criminal and civil suits. The principle is the same as me walking into your house and jacking your TV so I can take it home and watch it. Now does that make what I did right just because I didn't sell it for profit? Of course not. Am I immune to civil and criminal prosecution because I didn't pawn your TV for money? No I'm not. The same thing applies here.
